Yes.  This seems like the first workable proposal I have seen along
these lines.  (I think any scheme which allows enemy ships to remain in
the same system is very likely to have a nasty potential to create
endless battles.)

Indeed.  I doubt that this is too common though; I would think that the
unarmed ships would normally be destroyed first.
